An armed robbery or armed assault is a form of theft or dispossession of property in which the author of the crime causes violence , intimidation or physical condition in the victim using weapons , either a knife or firearm .
It is a type of robbery with a greater degree of severity than simple robbery, which is why it is very common for this type of crime to have a higher penalty than robbery without the use of weapons. The essential reason is that, although armed robbery is a crime that essentially attacks assets , it poses a greater risk to other protected legal assets such as the life or integrity of natural persons
In addition, the regulations provide that when the theft is committed through the use of weapons or other equally dangerous means, the penalty must be imposed in the upper half (that is, between 3 and a half years and five years in prison). [ 2 ]
